These terms are the agreement between you and TimeLens. The important parts: only upload photos you have the right to upload, AI output is generated and imperfect, and subscriptions bought through the App Store renew automatically until you cancel them in your Apple account settings.
1. Agreement
These Terms of Service (“Terms”) form a binding agreement between you and TimeLens (“we”, “us”) governing your use of the TimeLens iOS application, the timelens.spacewebsite and everything we provide through them (together, the “Service”). By downloading, opening or using the Service you accept these Terms. If you do not accept them, do not use the Service.
Your use of the Service is also subject to our Privacy Policy, which is incorporated into these Terms by reference, and to Apple’s Licensed Application End User License Agreement (the “Apple Standard EULA”).
2. Eligibility
You must be at least 13 years old, or the minimum age of digital consent where you live if that age is higher, to use the Service. If you are under 18 you confirm that a parent or legal guardian has reviewed and agreed to these Terms on your behalf. You must not use the Service if you are barred from doing so under any applicable law or sanctions regime.
3. What the Service does
TimeLens takes a photograph you provide, sends it to a third-party generative AI model together with a prompt associated with the effect you chose, and returns the generated image to your device. The catalog of effects is not fixed: we add, change, reprice and retire effects over time, and features such as the daily featured effect rotate automatically.
4. Your content
4.1 You keep ownership
You keep all rights you already have in the photographs you submit (“Input”). We claim no ownership of them.
4.2 The licence you give us
You grant us a limited, worldwide, royalty-free licence to host, transmit, process and modify your Input solely for the purpose of operating the Service and producing your result, and to permit our processors (currently Google and OpenAI) to do the same on our behalf. This licence exists only so that we can technically deliver what you asked for. It ends when the processing ends. It does not permit us to publish, sell, licence or train on your Input, and we do not do any of those things.
4.3 Your result
As between you and us, the generated image (“Output”) is yours. Subject to your compliance with these Terms, you may use Output personally and commercially. Note that generative models can produce similar Output for different users, that we make no representation that Output is original or protectable, and that copyright in AI-generated material is treated differently in different countries.
5. What you may not submit or do
You must not use the Service to:
- Upload a photograph of another identifiable person without their consent, or a photograph you do not otherwise have the right to submit.
- Create sexual, nude or suggestive imagery of any person, and under no circumstances any sexualised depiction of a minor.
- Impersonate a real person, fabricate imagery of a real person in a false or defamatory situation, or create material intended to deceive — including political disinformation and fraudulent identity documents.
- Produce content that is unlawful, harassing, hateful, threatening, or that promotes violence or self-harm.
- Infringe anyone’s copyright, trade mark, privacy, publicity or other rights, including by submitting copyrighted photographs that are not yours.
- Reverse engineer, decompile, scrape, or attempt to extract prompts, model weights or provider credentials from the Service; interfere with it; circumvent rate limits, cost caps, entitlement checks or paywalls; or use it via automated means.
- Resell or provide the Service to third parties as if it were your own.
Our providers additionally apply their own safety policies and may refuse a request. We may remove content, refuse generations, and suspend or terminate your access where we reasonably believe these rules have been broken.
6. Nature of AI output
Output is generated by a statistical model. It is a fabrication, not a photograph of anything that happened. It can be inaccurate, unflattering, distorted, biased, or simply wrong, and running the same effect twice will not produce the same result. Ageing effects, “future baby” effects and similar features are entertainment and are not predictive; they are not medical, genetic, forensic or identity-verification tools and must never be relied on as such.
You are responsible for how you use Output, including whether it is appropriate to share it and whether doing so respects the rights and feelings of anyone depicted.
7. Free use, subscriptions and billing
7.1 Free use
The Service offers a limited amount of free use — currently a one-off complimentary effect during onboarding, plus any free allowance we choose to enable. The size of this allowance is set remotely and may change at any time without notice.
7.2 Pro subscriptions
Full access is sold as an auto-renewing subscription (“Pro”) purchased inside the app through Apple. The current plans are $3.99 per week and $49.99 per year. The 3-day free trial is offered on the yearly plan only; the weekly plan is charged from the first day. Prices are shown in the App Store in your local currency before you confirm and may vary by region and over time.
7.3 Free trial
Where a free trial is offered, it converts to a paid subscription automatically at the end of the trial period unless you cancel at least 24 hours before it ends. Any unused portion of a free trial is forfeited if you buy a subscription before it expires.
7.4 Auto-renewal
Payment is charged to your Apple ID at confirmation of purchase. Subscriptions renew automatically for the same period at the then-current price unless auto-renew is turned off at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period.
7.5 Managing and cancelling
You manage and cancel subscriptions in your Apple account settings — Settings → your name → Subscriptions on your device. Deleting the app does not cancel a subscription. We cannot cancel it for you.
7.6 Refunds
All purchases are processed by Apple, and refunds are handled by Apple under their policies. We are not able to issue refunds directly. Requests can be made at reportaproblem.apple.com. This does not affect any statutory cancellation or refund rights you have as a consumer, which remain unaffected.
8. Our intellectual property
The Service — including the TimeLens name and mark, the app, the website, the effect catalog, the prompts behind each effect, and the design of all of it — is owned by us or our licensors and is protected by intellectual property law. These Terms grant you a personal, non-exclusive, non-transferable, revocable licence to use the app on Apple-branded devices you own or control, as set out in the Apple Standard EULA. Nothing else is granted.
9. Availability and changes
We aim to keep the Service running but do not guarantee that it will be uninterrupted, timely or error-free. We may modify, suspend or discontinue any part of it — including individual effects — at any time, and we operate a remote kill switch that lets us stop generations immediately if a provider fails or costs run away. We may impose usage and cost limits per device.
10. Termination
You may stop using the Service at any time by deleting the app. We may suspend or terminate your access immediately if you breach these Terms or if we reasonably believe your use puts the Service, our providers or other users at risk. Sections 4, 6, 8 and 10 through 14 survive termination.
11. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and any warranty that Output will meet your expectations.
Some jurisdictions do not allow the exclusion of implied warranties, so some of the above may not apply to you. Nothing in these Terms limits your non-waivable statutory consumer rights.
12. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill or reputation, arising out of or relating to the Service — including any consequence of Output you generated, shared or acted upon.
Our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the twelve months before the event giving rise to the claim, or (b) USD 50. Nothing in these Terms excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.
13. Indemnity
You agree to indemnify and hold us harmless from any claim, demand, loss or expense (including reasonable legal fees) brought by a third party arising out of your Input, your Output, your use of the Service, or your breach of these Terms — in particular any claim that you submitted a photograph of someone without their permission.
14. Governing law and disputes
These Terms are governed by the laws of Ireland, without regard to conflict-of-law rules, and the courts of Ireland have non-exclusive jurisdiction. If you are a consumer resident elsewhere in the EEA, the UK or another jurisdiction with mandatory consumer protection rules, you keep the benefit of those rules and may bring proceedings in your country of residence.
15. Apple
These Terms are between you and us, not with Apple, and Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support for the app. In the event the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price; to the maximum extent permitted by law Apple has no other warranty obligation whatsoever. Apple is not responsible for addressing any claim by you or a third party relating to the app, including product liability, regulatory non-compliance and intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
16. General
If any provision of these Terms is found unenforceable, the rest remains in force. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between us regarding the Service.
17. Changes to these Terms
We may update these Terms. The effective date at the top of this page shows when the current version took effect, and we will give notice in the app of material changes. Continuing to use the Service after a change means you accept the revised Terms.
